Acceptable Use Policy

The short version: Use ClustrOps for legitimate recruitment. Don't use it for fraud, spam, illegal hiring practices, or anything that harms candidates, clients, or the platform. Bad actors get removed — permanently.

1. Who This Policy Applies To

Every person who creates an account, uses ClustrOps, or accesses any part of the platform — including trial users and invited team members.

This Acceptable Use Policy ("Policy") applies to all users of ClustrOps, operated by FlyHii Solutions Private Limited. It forms part of your agreement with us alongside the Terms of Service.

By using ClustrOps, you agree to follow this Policy. If you invite team members to your account, you are responsible for ensuring they also comply.

We enforce this Policy to protect candidates (the people whose data gets uploaded), clients (the companies recruiters work with), other ClustrOps users, and the integrity of the platform itself.

2. What ClustrOps Is For

Legitimate recruitment operations — managing mandates, tracking candidates, raising GST invoices, sharing profiles with clients. That's it.

ClustrOps is built specifically for:

  • Managing live job mandates from client companies
  • Tracking candidates through a legitimate recruitment pipeline
  • Sharing candidate profiles with clients who have active hiring needs
  • Generating and managing GST invoices for placement fees
  • Managing client relationships, contracts, and billing records
  • Collaborating with your own recruitment team

3. Recruitment-Specific Prohibitions

These are violations specific to recruitment that damage candidates, clients, and the industry. Some are illegal under Indian law. All of them will get your account closed.

3.1 You Must Not Charge Candidates

Charging candidates fees — for registration, consideration, placement, shortlisting, or any other reason — is illegal under Indian recruitment regulations and is an immediate and permanent violation of this Policy.

ClustrOps may only be used for B2B recruitment where fees are charged to client companies, never to candidates.

3.2 You Must Not Post Fake Job Mandates

  • Creating job mandates for positions that do not exist
  • Creating job mandates without a confirmed or active client requirement
  • Using fake mandates to collect candidate data for resale or other purposes
  • Misrepresenting job terms, CTC ranges, company names, or role details to attract candidates

3.3 You Must Not Upload Fabricated Candidate Data

  • Creating profiles for candidates who have not consented to be represented by you
  • Inflating or fabricating candidate credentials, experience, CTC history, or qualifications
  • Duplicating real candidates under false names or contact details
  • Uploading candidate profiles scraped from job boards, LinkedIn, or other sources without explicit candidate consent

3.4 You Must Not Spam Candidates

  • Sending unsolicited bulk messages to candidates about roles they have not expressed interest in
  • Contacting candidates through ClustrOps for purposes unrelated to active recruitment
  • Using candidate contact information exported from ClustrOps for mass marketing unrelated to the specific mandate they were added for

3.5 You Must Not Upload Prohibited Personal Data

  • Aadhaar numbers — prohibited on the platform under all circumstances
  • Voter ID numbers, passport numbers, or driving licence numbers as structured data fields
  • Health or medical information of candidates
  • Biometric data of any kind
  • Caste, religion, sexual orientation, political views, or other sensitive personal data as defined under the SPDI Rules 2011

If such data is discovered on the platform, it will be removed without notice and the account may be suspended.

4. Platform Integrity Prohibitions

Don't try to break, copy, or misuse the platform itself. This includes scraping, reverse-engineering, account sharing across companies, and uploading malicious code.

4.1 Account Use

  • Sharing login credentials with people outside your business entity
  • Using a single ClustrOps account to operate multiple distinct, unrelated businesses
  • Allowing competitors to access your account to reverse-engineer the product
  • Creating multiple accounts to circumvent usage limits, trial periods, or bans

4.2 Technical Misuse

  • Reverse-engineering, decompiling, or extracting source code from ClustrOps
  • Scraping or using automated tools to harvest data from the platform
  • Bypassing rate limits, security measures, or access controls
  • Attempting to gain unauthorised access to other users' accounts or data
  • Uploading or transmitting viruses, malware, ransomware, or any malicious code
  • Conducting denial-of-service attacks or load tests against the platform without written permission
  • Probing for security vulnerabilities without written permission (responsible disclosure: email security@clustrops.com)

4.3 Competitive Misuse

  • Using ClustrOps to build a competing product or service
  • Sharing platform details, UI designs, or feature workflows with competitors under NDA or otherwise
  • Using aggregated data from ClustrOps to train a competing AI or data product

4.4 Intellectual Property

  • Uploading content that infringes on the copyright, trademark, or other intellectual property of any third party
  • Using ClustrOps branding, logos, or trademarks without written permission

5. General Legal Compliance

Indian law applies. Don't use ClustrOps to do anything illegal — in India or elsewhere.

You must comply with all applicable laws and regulations in using ClustrOps, including but not limited to:

  • The Digital Personal Data Protection Act, 2023 — including obtaining candidate consent before uploading their data
  • The Information Technology Act, 2000 and associated rules
  • Indian labour and employment laws, including Contract Labour (Regulation and Abolition) Act
  • Indian GST law — you must not generate invoices for fictitious transactions
  • Anti-money laundering, anti-bribery, and corruption laws
  • Any law of the jurisdiction in which your clients or candidates are located

You are solely responsible for ensuring your use of ClustrOps complies with the laws applicable to your recruitment business.

6. Consequences of Violation

Minor violations get a warning and a chance to fix things. Serious violations — fraud, illegal activity, harming candidates — result in immediate permanent ban. No exceptions.

IMMEDIATE PERMANENT TERMINATION — No Warning

The following violations result in immediate account closure with no notice, no refund, and potential reporting to law enforcement or regulatory authorities:

  • Charging candidates fees of any kind
  • Fabricating candidate credentials submitted to clients
  • Uploading malware or conducting security attacks
  • Fraudulent invoice generation for non-existent placements
  • Data theft — accessing or exporting other users' data
  • Repeated violations after a prior warning

WARNING + 7-DAY CURE PERIOD

For first-time or minor violations, we will notify you of the violation and give you 7 days to correct it. Failure to correct within 7 days results in suspension. Second violations of the same kind result in permanent termination.

Upon any termination for violation of this Policy, you will have 30 days to download your data. After 30 days, all data is permanently deleted. We are under no obligation to refund any subscription amounts paid.

7. Reporting Violations

If someone is using ClustrOps to harm candidates or act illegally, tell us. We investigate every report.

We investigate every report and respond within 3 business days. Reports are handled confidentially.

For security vulnerabilities specifically, email support@clustrops.com with subject line Security Disclosure. Please do not publicly disclose security issues before we have had a chance to investigate and respond.

8. Updates to This Policy

We may update this Policy from time to time. For material changes, we will notify you by email and in-app at least 30 days before the change takes effect. The current version always governs your use of ClustrOps. The "Last Updated" date at the top tells you when this version took effect.
